The precedent has been that folks (folks being either the thread creator or a moderator) can request that a thread be held on-topic from the onset. It depends. If the topic of the thread is shifting, then the off-topic post is by definition off of the original topic, but it is by assumption still relevant to the thread and thus not spam. That make sense?
