People just get confused because they see stuff like "Copyright Nintendo" or something, but the copyright is to the company not the name.
When you see the name of something on a product it will usually have a small "TM" near it, and sometimes "R" which I think is for registered trademark? I'm not sure on that one... heheh. I'm no lawyer either. ;P
