If it isn't distributed through the appstore and is available for free, then you'd obviously have to jailbreak your iphone to use it.

You have to pay $100 annually to be a member of the development program. This enables you to place applications on the store. Free applications don't cost the developer anything except the annual $100. Apple takes a 30% cut on all paid applications.
