Forum/Graal smilies?

Are we allowed to use the smilies on Graal related forums/websites? For example, the forums for Era, Zodiac, Project Mythic and so fourth.

Yeah, like, Stefan or Unixmad are probably the only ones capable of answering my question - so please?

Crono 06-26-2008 02:35 PM

You could ask Goboom, the creator. He made a lot more too.

Yeah, I know, he's been MIA for ages though.

xXziroXx 08-16-2008 07:42 PM

It would still be kinda cool to get an answer from one of you, Stefan or Unixmad.

Cow2001 08-16-2008 07:45 PM

I'm not sure even they may decide since they're not the copyright holders.
you should ask goboom, check out his contact details here

I doubt Goboom invested in a copyright for them. And I've been trying to contact Goboom for a while without success, thus making Stefan/Unixmad the only ones eligible to answer my question.

DrakilorP2P 08-16-2008 08:17 PM

How about just using them without asking? Even if it doesn't fall under fair use, it's unlikely that he'll sue due to the costs involved.

it's copyrighted to him because he created it, no investment is needed.

even if they say yes he could theoretically sue

Only in countries where the Berne Convention standards apply.

Oinkness 08-16-2008 09:04 PM

I don't think you can actually copyright a smilie without first paying royalties to the original creator... it's probably under fair use to say the least.

Graal content usually requires a transfer of copyright to Graal. If that applies to the smilies too, it is.

it's not really Graal content tho, and anyway I'm not sure the transfer of copyrights is even legit without an accepted agreement.

You accept it when you agree to Graal's Terms of Agreement upon creating an account.

You're right, it's not there, checked both the User Agreement and Rules of Conduct without finding the slightest trace.
